1. Definitions
Account: A unique digital account created for you to access our Service or parts of our Service.
Digital Assets: Cryptocurrencies, tokens, and other decentralized digital assets supported by our Service.
Company: Refers to Apex Exchange Inc., acting as the provider of the Service.
2. Risk Disclosures
Trading and holding Digital Assets involves significant risk and can result in the loss of your entire capital. You should carefully consider whether trading or holding Digital Assets is suitable for you in light of your financial condition. Prices are highly volatile and can fluctuate drastically in a short period of time. We do not guarantee any returns or prevent any losses on your investments.
3. User Obligations & AML/KYC
You agree to provide true, accurate, current, and complete information during the registration process. You are required to pass all Anti-Money Laundering (AML) and Know Your Customer (KYC) checks as requested by our compliance team. Failure to provide documentation will result in immediate account suspension and freezing of assets.
4. Privacy & Data Security
We employ military-grade AES-256 encryption. We never share your private keys, seed phrases, or unencrypted personally identifiable information with third parties except as legally mandated. By continuing to use our service, you consent to our collection, processing, and storage of your personal data as outlined in our Privacy Policy.
5. Dispute Resolution
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in New York, New York, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS"). You waive your right to participate in a class-action lawsuit.
